Benefits Review Board Decisions

The Benefits Review Board reviews workers’ compensation claims and issues appellate decisions in cases arising under the Black Lung Benefits amendments to the Federal Coal Mine Health and Safety Act of 1969, 30 U.S.C. §901 et. Seq. The Benefits Review Board exercises the appellate review authority formerly exercised by the United States District Courts. The decisions of the Benefits Review Board may be appealed to the United States Courts of Appeals, and thereafter to the United States Supreme Court.
